Detroit News: Advertising company sues Utah over new anti-spyware law
WhenU has sued the state of Utah over its Spyware Control Act, which makes it illegal for software to be installed on a computer that monitors web activity and sends information about that activity elsewhere. The law, which takes effect next month and carries $10,000 fines, also makes pop-ups illegal. WhenU argues that the law violates its constitutional rights to expression. Many of Utah's lawmakers believe those rights can be curtailed when they pop up atop other advertisers' ads.
