Wal-Mart has asked a Michigan state court to throw out a lawsuit filed by fired marketing exec Julie Roehm, stating the legal battle should be fought in Arkansas - where Roehm resides, reports MarketWatch.
Wal-Mart fired Roehm after only 10 months over ethics breaches centering around an affair she allegedly had with another executive, Sean Womack. Since then, Roehm fired back with a lawsuit due to breaching her contract, which Wal-Mart answered with its own countersuit claiming similar charges.
The request to throw out the case in Michigan is due to confusion as to where Roehm resides. Though she has residences in both Michigan and Arkansas, she paid taxes and has a driver's license from Arkansas. Further, her employment contract states that any dispute must be heard in Arkansas and most of the witnesses reside there.
