Email list suppression firm UnsubCentral announced it now can scrub email lists of those domains the Federal Communications Commission rendered forbidden last week. The FCC deemed the list mobile domains, meaning that people cannot send commercial email to them unless they've been given explicit permission from the recipient. [See criteria in the jump.] UnsubCentral's Affiliate Manager application helps marketers keep tabs on suppression lists and verifies that unsubscribe requests have been properly noted. The firm boasts Advertising.com, Commission Junction and RealNetworks as clients.
The new rules about to take effect require the following:
What disclosures are required for express prior authorization requests?
• Subscriber agrees to receive MSCMs (mobile service commercial messages) from a specific sender whose identity is provided at that time.
• Subscriber must agree to receive messages from affiliated entities.
• Subscriber provides their e-mail address that MSCMs may be sent to.
• Subscriber is informed that their wireless provider may charge them to receive MSCMs.
• Subscriber is told that they may revoke their authorization to receive MSCMs at any time.
In what format must the disclosure be provided?
• Must be placed in a place that is "readily apparent" to the subscriber.
• Must stand alone (be presented separately from other authorizations).
• Must be entirely one language (if a portion is translated into another language, then all portions must be translated into the same language).
• If written, clearly legible with sufficiently large type.
• If oral, sufficiently audible.
