Neiman Marcus lost its trademark appeal to prevent the anti-fur group Fund for Animals from using a similar sounding domain name, neimancarcass.com. The arbitration judge ruled that the names were sufficiently different to prevent consumer confusion, the main test in trademark cases.
This constitutes yet another ruling going against corporations seeking to quash criticism or satire using trademark law. But often the damage may be inflicted merely by making and losing the case, as the Fund for Animals had to pay legal fees for its victory. As of this morning, though, the neimancarcass.com site was not responding.
