TechNewsWorld: Eolas Attorney Refutes W3C Objections to Web Patent
As Internet standards bodies and other strange bedfellows of Microsoft fight against Eolas attorneys in a bid to show that Eolas's patent is invalid, the fact remains that the judge in the case where Eolas won a half-billion-dollar judgment against Microsoft didn't consider prior art arguments in making his decision.
In effect, Eolas was presumed to have a valid patent, and the arguments we hear now - as in the case of this TechNewsWorld article - have yet to be considered by the judiciary. Microsoft is appealing the verdict, and will likely see the decision reversed due to the strange way the judge handled the case.
This may not prevent, however, Microsoft from deliberately breaking the method in which Internet Explorer handles rich media, as the monopoly software maker has caused user confusion in the past to make a point to a judge that legal claims against it are not in the best interests of consumers.
