Brian Bogosian, CEO of mobile email startup Visto, claiming that Microsoft is infringing on three of its patents, is suing the software company and seeking "unspecified monetary damages" as well as an injunction barring Microsoft's sale of products, writes Forbes.com. The suit was filed Wednesday, when Visto also announced that NTP had taken an equity stake in Visto and signed a patent-licensing deal.
Forbes points out that the allegations against Microsoft parallel those by NTP against BlackBerry maker Research in Motion, which as a result now faces a shutdown of its messaging service in the U.S.
The suit was filed in the U.S. District Court for the Eastern District of Texas and challenges three Microsoft patents, seeking to block Microsoft's Windows Mobile Direct Push Technology, which Microsoft expects to introduce in the spring, writes the New York Times.
Microsoft said it would not comment on the lawsuit until it reviews the court filing. Cingular, Vodafone and Sprint Nextel resell Visto's wireless email service under different brand names.
