DM News: First DNC Action Sparked By Call To FTC Commissioner
Note to telemarketers: take the FTC commissioners off your call list, especially if they've registered with the Do Not Call (DNC) Registry. It turns out that the first FTC enforcement action against an alleged DNC violator came after Commissioner Orson Swindle was called by the National Consumer Council. That action was announced May 5, more than half a year after the Registry supposedly went into effect.
DNC violation actions typically involve notifying the alleged perpetrator company that an investigation is getting underway. But in cases where the DNC violation also involves potential fraud, no such notification is given. As a result, it may prove that when the FTC finally lolls around to actually enforcing the new policy, many or most of those actions may concentrate on fraud actions, as those may prove easier to prosecute due to evidence obtained under cover.
This policy also helps ensure that large commercial interests violating the Registry will not be visited upon quite like the smaller scam artists who just happen to be violating the DNC policies.
