eWeek: Eolas Rebuts Initial Patent Finding
The Eolas patent case isn't quite dead. The patent holder, which had previously won a now-invalidated half-billion dollar judgment against Microsoft, appealed the Patent Office's initial finding that it should never have granted the patent in the first place. In February, a patent examiner found substantial prior art that would invalidate the patent. Eolas issued a rebuttal today that its lawyer said basically rehashed the arguments it made in its trial against Microsoft.
Had it remained valid, Eolas would have been able to force most if not all rich media and ad serving companies to pay license fees.
