eMarketer Denies It Copied Data Unfairly

BtoB Online: eMarketer issues statement rebuking Jupiter lawsuit

eMarketer, an aggregator of internet-oriented research, made a public statement on the suits lodged against it by Jupitermedia, a publisher of internet-oriented research. Jupitermedia sued eMarketer this past May for allegedly misappropriating proprietary research and publishing it. For its part, eMarketer claims that any Jupitermedia research it published was garnered from public sources and, presumably, constitutes "fair use."

While the BtoB online story linked above makes mention of cease-and-desist letters sent to eMarketer in France and Britain, Jupitermedia's chief Alan Meckler said in his blog a few weeks ago that he was already bringing legal action against eMarketer in those two countries. Both France and the U.K. have weaker protections for fair use of copyrighted materials.
