CNET: Pop-up purveyor Claria settles suits
Claria settled trademark lawsuits brought by several online companies, such as Wells Fargo and Quicken Loans. Terms weren't disclosed, but after similar suits filed in years past were settled, Claria stopped allowing its adware pop-ups from appearing on litigants' sites. A Claria executive said that in addition to settling the suits, some of the former litigants had formed business relationships with the adware firm. Claria still faces an April lawsuit from Teleflora. With the new settlements, the legal issue of whether or not sending a pop-up ad targeted to a user viewing certain types of web pages constitutes an abuse of trademark or copyright still has yet to be decided in court.
