JibJab Handicapped to Win Rights Suit

Wired: JibJabbing for Artists' Rights

Canvassing a bunch of intellectual property lawyers, Wired reports that the JibJab Media case against would-be copyright enforcer Ludlow Music seems pretty cut-and-dried. It seems everyone agrees that the JibJab political parody that used a Woody Guthrie song - the rights to which are owned by Ludlow - is a pretty simple case of "fair use." JibJab filed for a judgment to declare it non-infringing after Ludlow sent at least two legal nastigrams and before Ludlow even filed suit.
