Utah Anti-Spyware Law Delayed for Hearing

ClickZ: WhenU Suit Delays Utah Anti-Spyware Law

Utah agreed to delay for a few weeks implementation of its new and broad anti-spyware law. Adware firm WhenU sued Utah to prevent the law from coming into effect, and a hearing couldn't be scheduled before the legislated effective date. The law would presumably make WhenU's software illegal, along with other adware packages, such as those from Claria and, possibly, tracking mechanisms used by ubiquitous ad servers such as DoubleClick Dart.

Interestingly, WhenU is pursuing the case in Utah courts first, rather than opting to move it to a federal forum, something they might be able to easily do since they are headquartered in a different state.
